I’ll See You in Court!

    Those are powerful words. They are threatening words. If you think about it, when people have disputes, they don’t really want to go to court in all situations. Yes, it could make one side feel powerful when they tell the other, “I’ll see you in court.” Yes, those words show force. But they also cost money.

    That’s why people don’t always want to go to court. If a business deal turns bad, going to court could be the first thing that comes to mind for some people. Someone didn’t pay for goods received. Someone didn’t deliver goods on time. Textiles were damaged during shipment. The freezers in the restaurant didn’t work properly. The underground storage tanks in the gas station didn’t meet environmental standards.

    The list of things that could create disputes in business dealings is endless. Sometimes suing and going to court could be the only possible option. The other side didn’t return calls. The other side refused to replace spoiled goods. The other side was hostile.

    When people go to court, they are usually frustrated. But no matter how powerfully someone threatens court, there are sometimes more economical solutions. Sometimes a conference call or a virtual meeting could repair relations. Sometimes a mediator could help find a peaceful solution. Sometimes good negotiation skills could save the day.

    Going to court could show the other side you mean business. But in the end, one has to consider whether the legal fees and stress are worth it. Going to court can be a powerful tool. And it can sometimes be the only option. But it can be costly to employ. It can damage working relationships. And it could sometimes take the matter out of the business owner’s hands, where the court process dictates things.

    There’s no magic answer for all disputes. But the decision to go to court is one that can require some careful thought. Sometimes, going to court is the only option. And sometimes, less expensive options could be wiser.
